The U.S. Department of Justice has asked the Supreme Court of the United States to allow the administration to move forward with ending deportation protections for more than 350,000 Haitian immigrants currently living in the country under Temporary Protected Status (TPS). The request, filed Wednesday, marks the latest development in ongoing legal disputes over the U.S. Department of Homeland Security’s effort to terminate TPS designations for several countries. If the designation is removed, many immigrants who currently benefit from the program could become eligible for deportation. The Supreme Court has already allowed the administration to scale back similar protections for Venezuelan migrants. A separate case involving Syrian immigrants is still pending before the court. Haiti first received TPS in 2010 following a devastating earthquake that killed more than 300,000 people and caused widespread destruction across the country. The designation allowed Haitians living in the United States to remain temporarily and obtain work authorization while conditions in their homeland stabilized. During his first administration, Donald Trump moved to end Haiti’s TPS designation. However, that effort became entangled in legal challenges and was never fully implemented before he left office. After returning to the presidency, Homeland Security Secretary Kristi Noem announced plans to terminate Haiti’s TPS status, with the change scheduled to take effect on February 3. She said the move reflected confidence in Haiti’s progress and aligned with the administration’s broader foreign policy goal of encouraging a stable and self-reliant nation. But five Haitian nationals filed a lawsuit challenging the decision. U.S. District Judge Ana Reyes ruled last month to temporarily block the policy, citing concerns that the decision may have been influenced by improper considerations. The Justice Department argues the ruling could undermine numerous immigration policies and improperly limit executive authority over immigration decisions.
